All prices are subject to change without notice. All wholesale prices include excise duty where applicable but exclude government sales tax. Terms Payment to 'Bacchant Wine Merchants' shall be made in cash with the customers order unless the customer completes an 'application for credit', where upon full payment for all invoiced items shall be made by the fourteenth (14th) day of the month following the month in which the goods have been delivered to the customer. Cheques and payments shall be made payable to 'Bacchant Wine Merchants Pty ltd'. Payment by cheque shall not be deemed made until the cheque(s) have been cleared.
If you (the purchaser) fail to pay for the goods on the due date then, even though Bacchant Wine Merchants Pty Ltd reserves title to the goods supplied to you and without prejudice to any other rights and remedies you may have, Bacchant Wine Merchants Pty Ltd may sue you for the price of the goods as a liquidated sum. Retention Of Title All goods delivered by Bacchant Wine Merchants remain the property of Bacchant Wine Merchants and the title of any goods does not pass to the purchaser until all debts owed to Bacchant Wine Merchants on any account whatsoever, including interest, bank charges, legal fees and collection expenses are paid to Bacchant Wine Merchants in full.
The purchaser grants the right for Bacchant Wine Merchants to enter the purchasers premises, or any other premises, where the goods are reasonably believed to be stored and take possession of the goods with out notice. Ullages And Claims Claims for damages or loss of stock during transport must be reported to Bacchant Wine Merchants at the time of delivery.
Claims for faulty stock (label damage, leakers or short fills) accepted for replacement provided seals on bottles are intact. Claims for faulty stock must be made within twenty-four (24) hours of delivery.
